Terms and Conditions

This contract for the rental of a venue is made this day, by and between Modern Moments, hereafter referred to as the Lessor , and client whose name is listed on invoice, hereafter referred to as the Lessee. Whereas, the Lessee desires to temporarily rent, occupy, and make use of the Lessor’s venue, located at 882 W Rialto ave Rialto CA 92376, known as Modern Moments. Whereas, the Lessor agrees to such rental, occupation, and use in consideration of certain payments and covenants herein enumerated; NOW, THEREFORE, THE PARTIES AGREE TO THE FOLLOWING TERMS & CONDITIONS: 1. The Lessee shall pay to the Lessor the sum total no later than the due date. The reservation fee listed to confirm booking is a nonrefundable payment that will be applied to total rental charges to reserve your date. 2. The Lessee shall have access to and use of the venue during the stated time period on the invoice, for the purpose of hosting the Lessee’s event. Lessor shall provide to Lessee all keys, access control codes, and other items necessary to give Lessee such access no later than the day of the event prior to the rental period. 3. The full rental fee for the use of the venue described in (2) above shall be paid in full no later than 7 days prior to the event date. The balance of the rental fee due, less the non-refundable payment described in (1) above, shall be payable to the Lessor upon the expiration of the rental period described in (2) above. 4. If Lessor must cancel your event due to unforeseeable circumstances, Lessor agrees to release Lessee's reservation fee within 48 hours of notice. 5. Lessee shall remove all personal property, trash, and other items that were not present in the venue when Lessee took control of it. 6. Upon Lessees completion of his/her obligations, the Lessor shall return to Lessee the security deposit minus any amounts deemed necessary to repair damages inflicted upon the venue by Lessee and/or Lessee’s associates, guests, invitees, contractors, and all other persons whatsoever who enter the venue during the rental period, whether or not such persons did so with Lessee’s knowledge or consent. 7. Insurance Lessee, their agents, employees, invitees, and/or contractors, are advised to have insurance to protect their event. If Lessee gets insurance, it shall include "Modern Moments" located at 882 W Rialto Ave, Rialto, CA 92676 as an additional insured. If you don't have insurance, companies such as "The Event helper" at www.theventhelper.com provides great reasonable rates for insurance. 8. Lessee will be liable for any physical damages, legal actions, and/or loss of reputation or business opportunities that Lessor may incur as a consequence of the actions of Lessee or any of Lessee’s guests while Lessee is in control of the venue, and shall indemnify and hold harmless the Lessor against any and all legal actions which may arise from Lessee’s use of the venue.HOUSE RULES Overtime. If Lessee stays overtime, Lessor will be charge for overtime use in 30-minute increments. 30 minutes will be billed at $100, a full hour will be $200.00 Camera Recording. The Lessee is notified and agrees that a live camera recording of Modern Moments is on at all times during its event. The recording is in the public area of Modern Moments and is monitored and functional at all times. The Lessee accepts full responsibility to notify all its guests. Alcohol. Alcohol is not permitted unless provided by a licensed bartender to serve alcohol at this event. All persons must be 21 years of age or older. All alcohol must be consumed inside the property. Lessor may grant the right to have beer, wine or champagne to lesses without need of licensed bartender. NO SMOKING Lessee agrees that the lessor has a zero-tolerance smoking policy and that any sign of smoking will result in a $500.00 charge. NO CONFETTI OR GLITTER Lessee shall not dispense glitter or confetti on-premises. Confetti may be allowed based on authorization lessor
