Terms and Conditions
Tony E. Photography & Digital Media, hereinafter referred to as the "Photographer," and [Client's Name], hereinafter referred to as the "Client," agree to the following terms and conditions for photographic services:
1. Services
The Photographer agrees to provide photography services as outlined in the attached proposal or invoice, which may include but is not limited to photography sessions, retouching, image processing, and the delivery of final images.
2. Date, Time, and Location
The parties agree on the date, time, and location of the photography session. Any changes to this schedule must be agreed upon in writing.
3. Payment
The Client agrees to pay the Photographer the total amount specified in the proposal or invoice. Payment can be made in installments as outlined in the proposal. The Photographer reserves the right to withhold deliverables until full payment is received.
4. Cancellation and Rescheduling
a. If the Client cancels the photography session, any deposits or prepayments will not be refunded.
b. In the event of inclement weather or unforeseen circumstances, the photography session may be rescheduled at a mutually agreed-upon time.
5. Copyright and Usage
The Photographer retains the copyright to all images created during the photography session. The Client receives a personal, non-commercial, and non-exclusive license to use the images. The Client may not sell, modify, or license the images to third parties without the Photographer's written consent.
6. Model Release
The Client grants the Photographer the right to use the images for promotional purposes, including but not limited to portfolio, website, social media, and marketing materials. If the Client wishes to keep their images private, they must notify the Photographer in writing.
7. Retouching and Editing
The Photographer will provide basic retouching and editing services to the images. Additional retouching requests may incur extra fees.
8. Delivery of Images
The Photographer will deliver the final images to the Client within [specify time frame] after the photography session. The delivery method will be specified in the proposal.
9. Liability
The Photographer is not responsible for any injury, damage, or loss of property that may occur during the photography session. The Client is responsible for their own safety and the safety of their belongings.
10. Dispute Resolution
In the event of a dispute, both parties agree to first attempt to resolve the issue through negotiation or mediation. If this fails, the dispute will be subject to the laws of the [jurisdiction] and may be taken to court.
11. Entire Agreement
This contract constitutes the entire agreement between the Photographer and the Client and supersedes any prior verbal or written agreements.
