Terms of Service / Cancellation policy All cancellations must be made in writing to the Performer and will be subject to the following terms. a) In the event of cancellation of the contract by the Client, payments already made to the performer will not be refunded. b) If the Contract is cancelled by the Client within 30 days of the Event Date, 50% of the Balance will be due. c) If the Contract is cancelled by the Client within 15 days of the Event Date, 100% of the Balance will be due. d) The Performer agrees to meet its obligations under this Agreement subject to legitimate incapacity by sickness or accident. e) The Performer is also responsible for finding a fair solution by sending a competent substitute of the same quality to the performance. Failure to perform will result in the Performer returning any outstanding funds to the Purchaser. f) In the event the Performer cancels the Performance, the Performer will promptly return the deposit and any payments already made back to the Purchaser. g) Neither the Performer nor the Purchaser will be held liable for any failure to perform its obligations under this Agreement where such breach is due to acts or regulations of public authorities, labor difficulties or strikes, inclement weather, epidemic, interruption or delay of transportation service, acts of God, or any other legitimate cause beyond the reasonable control of the Performer and the Purchaser. h) The Performer will be compensated by the Purchaser for any and all damage done to the Performer's equipment by the Purchaser, its agents, or guests. i) The Purchaser indemnifies and holds the Performer harmless for any and all property damage or personal injury that results from or is related to the Performance, not directly caused by the Performer. j) The Purchaser warrants and represents that it has obtained any and all permits, approvals, licenses, and variances necessary for the Performance. k) The Purchaser will take reasonable precautions for the safety of the Performer and the Performer's equipment during all aspects of the Performance and at all times while the Performer and the Performer's equipment are on the Venue premises. This includes shade during the performance, and away from harm or inclement weather at all times. Governing Law: The Purchaser and the Performer submit to the jurisdiction of the courts of the State of CA for the enforcement of this Agreement or any arbitration award or decision arising from this Agreement. This Agreement will be enforced or construed according to the laws of the State of CA. Terms of Service and Payment: By completing the deposit payment, you agree to the terms and payment of the final balance established in the invoice or in the contract attached to this invoice upon completion of the service provided, whether you sign the contract or not.
