• In Motion Video promises to record the events with satisfactory video images and sound. In Motion Video’s liability regarding the videotaping of this event can in no instance exceed the total amount paid. This limitation on liability shall also apply in the event that materials are damaged in editing, or due to camera malfunction, or otherwise lost or damaged. If In Motion Video cannot perform this agreement due to causes beyond our control, including health or weather-related issues, then our liability is limited to the total sum paid.
• A deposit is due at the signing of this agreement with the remaining balance to be paid two weeks before the wedding. Each additional half hour In Motion Video is asked to provide videography services on the actual wedding day, which are beyond the scope of the contract (7 hours), will be billed at $100 per half hour.
• A 20 minute break will be allowed during dinner at which time a vendor meal will be provided to the videographer. If no vendor meal is included, a $100 surcharge will be added to this contract.
• No footage will be released until all payments are made in full. In the case of cancellation, the deposit is non-refundable. If the event is moved to a date other than that listed here, and In Motion Video cannot perform this contract due to other personal or professional obligations, the deposit is non-refundable, but the customer will have no further debts to In Motion Video. In the case of a date change, In Motion Video reserves the right to find a suitable replacement videographer, and if possible, the client may accept the replacement and apply the deposit towards the replacement. In Motion Video does not, however, guarantee the securing of a replacement, in which case the deposit will be held by In Motion Video.
• Once payment is made in full all DVDs will be delivered within 60 days.
• Copies can be ordered within six months of the event with guaranteed delivery. Beyond that date, In Motion Video does not guarantee delivery of additional copies for any fee. After all footage, including any additional copies ordered within six months of the event date, are delivered, all original footage will become the exclusive property of In Motion Video. In Motion Video may use the footage for In Motion Video’s self-promotion.
• Any modifications of this agreement must be in writing and signed by both parties.
