In consideration of the services to be performed by MARITA LYNN CATERING for the benefit of the purchaser of the "Thanksgiving Package" as set forth below, client agrees to the following terms and conditions:
1.-The package price is subject to appropriate adjustment upon notice to customer due to increase in the number of guests attending the event.
2.-In the case of unexpected consumption or usage during the event, Marita Lynn Catering will make reasonable attempts to meet the requests, at the customer’s expense.
3.-Total ordered is due upon confirmation of order.
4.- If the event is cancelled by the customer, the following amounts, if any, shall be due to the customer: a.) If cancellation is more than thirty days (30) prior to the scheduled date of the event: Ninety (90%) percent of the deposit. b.) If event is cancelled, or rescheduled for a time that preludes caterer’s performance more than ten (10) days, but less than thirty (30) days prior to the event: Fifty (50%) percent of the deposit. c.) If the event is cancelled, or rescheduled for a time that preludes caterer’s performance, less than ten (10) days prior to the event: no deposit will be returned.
5.-If no labor is to be provided for herein, customer’s acceptance of such product upon delivery shall be deemed full performance of caterer’s obligations arising hereunder.
6.- Marita Lynn Catering will endeavor to provide everything called for in this agreement. If customer requests any additions, customer agrees to pay accordingly.
7.- Client shall provide caterer access as reasonably needed both prior to, and subsequent to event for purpose of delivery and pick up of property furnished by caterer.
8.- Marita Lynn Catering shall not be responsible for inability to provide food or other services due to inclement weather or acts of God (including, without limitation, fire or earthquake).
