Payment: Party Up Entertainment will hold this event as “tentative” for a period of 7 days from the contract date. To confirm this agreement, return one signed copy along with the required deposit. Agreements received after the “tentative” period are subject to availability and could result in a loss of the event date. If sending a deposit, the balance is due no later than the day of the event, prior to performance. Payments can be made by cash, check or credit card. Final payments made by personal check must be made two weeks prior to event date. Gratuities give to an entertainer at the event are made at the sole discretion of the client.
Cancellation: This agreement cannot be canceled or modified except in writing by either the client or Party Up Entertainment. If the client initiates cancellation less than 60 days prior to the event date, the deposit will be forfeited. Forfeited funds may be applied to a new agreement signed within 14 days of notice of cancellation. If Party Up Entertainment initiates cancellation all funds collected will be returned. Rescheduling of events due to inclement weather shall be accommodated whenever possible and is subject to availability.
Overtime: When possible, client requests for extended performance time during an event will be accommodated. Overtime may be requested in 30 minute increments, at the rate specified above. Payment for overtime is due at the time of request and may be paid by cash only.
Entertainers: Clients choice of entertainers is offered on a first come, first served basis. If a specific entertainer is not selected. Party Up Entertainer will assign an available entertainer best suited for your event. If by unavoidable circumstances, your scheduled is not able to perform on the date of your event. Party Up Entertainment will substitute and entertainer of similar experience.
Provisions: The client shall ensure that: (1) performance facility provides entertainer with a sturdy covered table approximately 2’x6’ in area within 25 feet of a 110-volt outlet (3 prong grounded), (2) facility is open at least one hour prior to scheduled start time, (3) facility meets all Federal, State and local regulations and has appropriate music licenses and performance permits, (4) Reasonable steps will be taken to protect Party Up Entertainment’s equipment, personnel and music, (5) Crowd control will be provided if warranted, (6) for outdoor performances, shelter is provided that completely covers and protects Party Up Entertainment’s equipment from adverse weather conditions. Client accepts full responsibility and is liable for any damages, injuries or delays that occur as a result of failure to comply with these provisions. In the event of circumstances deemed by the entertainer to present a real or implied threat or injury or harm to the entertainer, equipment or recordings, the entertainer reserves the right to cease performance until such time as the client resolves the threatening situation. Entertainer further reserves the right to deny guest access to recordings or equipment. In the unlikely event that a performance is delayed, liability is limited to providing performance time equal to time lacking. Party Up Entertainment holds all appropriate insurances for it’s equipment and personnel.
