Terms and Conditions

Retainer is required to hold event date. This agreement covers only the specific date indicated above for BAY AREA DJS to provide mobile DJ services for a fee. BAY AREA DJS is being retained by the Client whose name appears above, as authorized by the party whose signature appears below as a represenitive of the Client. Client agrees to pay all fees and deposits in the following manner: The agreement of the DJ to perform is subject to proven detention by accidents, riots, strikes, epidemics, acts of God, or any other legitimate conditions beyond their control. The Client shall at all times have shared input to determine the services provided by DJ at this engagement. With or without the aid of client’s music list, DJ will make every effort to play the Client’s and Client’s guests’ music requests, but shall not be held responsible if certain selections are not available. DJ requests access to the venue is permitted one hour before the engagement for setup and testing of equipment and forty five (45) minutes after the engagement for equipment takedown. Client is responsible for paying any charges imposed by the venue. These charges include, but are not limited to, parking fees, electrical connection fees, venue staff, time used at venue before and after the event for equipment setup and take down. If any guest or any person from the Client’s party damages any equipment the Client is fully responsible to replace or fix broken item. ___________(Initial) Client is responsible for setup space for the equipment and services of DJ. DJ will use his best professional efforts to make the client’s event enjoyable and memorable. DJ cannot warranty or guarantee and specific result or outcome. Neither the DJ nor the client will be liable to the other for any incidental, special or consequential damages. DJ’s liability for any claim under this agreement will not exceed the amount paid by the client for the services on which the claim is based. This Contract is not binding until it is received and signed by DJ/Client, and retainer is received by DJ. Retainers are NON-REFUNDABLE ____________ (Initial) Oral agreements are non-binding. If any clause in this Contract is found to be illegal, the remainder of the Contract shall remain in full force.
